Welcome to BDStudents. These Terms and Conditions ("Terms") govern your access to and use of the BDStudents website at https://bdstudents.org and any related services, features, and content (together, the "Service").

The Service is operated by the BDStudents project ("BDStudents," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, Acceptable Use Policy, and Cookie Policy, each of which is incorporated here by reference. If you do not agree, do not use the Service.

1. Who We Are

BDStudents is a community platform that connects Bangladeshi students studying at colleges and universities around the world. The Service provides a directory of students, institutions, and clubs, tools for university chapters and student clubs to organize, and a space to share information and resources.

In these Terms, "BDStudents Operators" means BDStudents and the founders, organizers, contributors, moderators, and volunteers who operate or support the Service, together with any entity that may later operate the Service. References in these Terms to what "we" are not liable for, and to parties protected by the disclaimer, limitation of liability, and indemnification provisions, apply to all BDStudents Operators.

2. Eligibility

To use the Service, you must:

  • Be at least 16 years old; and
  • Be enrolled in, or actively preparing to enroll in, college or university-level education (grade 11 and above, or equivalent).

The Service is not directed to children under 16 or to younger high-school students, and we do not knowingly permit them to register.

If you are between 16 and 18 (or below the age of legal majority where you live), you represent that you have permission from a parent or legal guardian to use the Service, and that your parent or guardian has reviewed and agreed to these Terms on your behalf.

By using the Service, you represent that you meet these requirements and that the information you provide is accurate and current.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly at legal@bdstudents.org of any unauthorized use. We are not liable for any loss arising from your failure to safeguard your account.

We may suspend or terminate accounts that violate these Terms, our Acceptable Use Policy, or applicable law.

4. User Content

The Service allows you to create, post, and share content, including profile information, posts, comments, club and institution information, and uploaded files (together, "User Content").

You retain ownership of your User Content. By posting User Content, you grant BDStudents a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that content solely for the purpose of operating, providing, and improving the Service. This license ends when you delete your User Content or your account, except where the content has been shared with others who have not deleted it, or where we must retain it to comply with law.

You are solely responsible for your User Content. You represent that you have the rights to post it and that it does not violate these Terms, our Acceptable Use Policy, or the rights of any third party.

We do not endorse and are not responsible for User Content posted by others. We may, but are not obligated to, review, moderate, or remove User Content at our discretion.

5. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy. Violations may result in removal of content, suspension, or termination of your account.

6. Clubs, Chapters, and Organizations

The Service enables university chapters and student clubs to organize members, roles, and activities. If you create or manage a chapter or club, you are responsible for the accuracy of the information you provide and for the conduct you authorize within your organization on the Service.

BDStudents provides the platform that records and displays organizational information. BDStudents is not a party to, and is not responsible for, any arrangement, event, membership, or financial matter organized by a club or chapter, whether on or off the Service.

7. Fees

The Service is currently provided free of charge.

8. Intellectual Property

Except for User Content, the Service and all materials on it, including the BDStudents name, logo, design, text, graphics, and software, are owned by BDStudents or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive license to access and use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

9. Copyright Complaints

We respect intellectual property rights and expect users to do the same. If you believe content on the Service infringes your copyright, send a notice to our designated agent at legal@bdstudents.org that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and where it is located on the Service; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and (f) a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act on the owner's behalf.

We respond to valid notices under the U.S. Digital Millennium Copyright Act (DMCA), which may include removing the material and terminating repeat infringers' accounts. If you believe your content was removed in error, you may submit a counter-notice to the same address.

10. Third-Party Services and Links

The Service relies on third-party providers to operate and may contain links to third-party websites or resources. We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their own terms.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. To the fullest extent permitted by law, the BDStudents Operators disclaim all such warranties. We do not warrant that the Service will be uninterrupted, secure, timely, or error-free, that defects will be corrected, or that information on the Service is accurate, reliable, or complete. You use the Service at your own risk.

Information shared on the Service by us or by other users, including advice about visas, housing, scholarships, institutions, or living abroad, is provided for general informational purposes only and is not professional, legal, financial, immigration, or other advice. You should verify important information independently before relying on it.

12. No Responsibility for User Content or Conduct

The Service hosts content and interactions created by users. To the fullest extent permitted by law, the BDStudents Operators are not responsible or liable for any User Content, or for the conduct of any user, whether on or off the Service. This includes content or conduct that is unlawful, inaccurate, offensive, harmful, or that infringes the rights of others, and any loss or harm arising from your reliance on, or interaction with, any User Content or user.

We have no obligation to monitor User Content, and any moderation we choose to perform does not make us responsible for content we do not remove. Interactions between users, including any meeting, transaction, membership, event, or arrangement, are solely between those users, and the BDStudents Operators are not a party to them and bear no responsibility for them.

13. Limitation of Liability

To the fullest extent permitted by law, in no event will the BDStudents Operators be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, use, goodwill, reputation, or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the Service, the conduct of any user, or any User Content, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

To the fullest extent permitted by law, the total aggregate liability of the BDStudents Operators for all claims arising out of or relating to the Service will not exceed one hundred US dollars (USD 100).

These limitations apply to the maximum extent permitted by law. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including, where applicable, liability for fraud, gross negligence, or willful misconduct, or mandatory rights under data-protection or consumer-protection law.

14. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless the BDStudents Operators from and against any claims, demands, damages, losses, liabilities, and expenses, including reasonable legal fees, arising out of or related to your use of the Service, your User Content, your conduct toward other users, or your violation of these Terms, applicable law, or the rights of any third party.

15. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms or applicable law, or to protect the Service or its users. Provisions that by their nature should survive termination will survive, including sections on User Content licenses already granted to others, intellectual property, disclaimers, limitation of liability, and indemnification.

16. Changes to the Service and These Terms

We may modify or discontinue the Service, in whole or in part, at any time. We may also revise these Terms. If we make material changes, we will provide notice through the Service or by email before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

17. Business Transfers

If BDStudents is reorganized, incorporated into a new entity, merged, acquired, or transferred, in whole or in part, these Terms and your information may be transferred to the successor or acquiring party as part of that transaction. We will note any such change through the Service.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the non-exclusive jurisdiction of the state and federal courts located in Arizona.

Nothing in this section limits any mandatory consumer or data-protection rights you have under the laws of your country of residence, including, where applicable, the rights of users in the European Union and United Kingdom.

19. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with the policies referenced in them, constitute the entire agreement between you and BDStudents regarding the Service. You may not assign these Terms without our consent; we may assign them as described in Section 17.
